Gloria Bennett has filed suit against Trent Miller and The Rusty Nail Antiques, LLC of Vernon. She seeks the dissolution of the business; is asking for triple damages for monies she has invested and to be repaid; an accounting of all monies Miller has received in operating the business; and is alleging theft of inventory and other personal property belonging to the Bennett-Miller partnership.
The plaintiff and defendant began an informal partnership with no written agreement in Nov. 2017 and rented a building in North Vernon. In March 2018, Miller organized a limited liability company (LLC) called The Rusty Nail Antiques, LLC with himself as the sole member. Bennett purchased a building at 43 N. Pike Street in Vernon and the business moved into that location. Its ribbon cutting was held in May.
The suit alleges that Miller has rented spaces in flea market malls and taken "an unknown quantity of inventory" from The Rusty Nail and that he is using the Chevy Tahoe purchased by the plaintiff for the business in both of their names "solely for his personal use."
Bennett says she has invested $24,100 in the business; $3500 to repair the building in North Vernon and $2000 for the box trailer the business was to use. She is asking for triple damages to be awarded, per Indiana Code, as well as all attorney and court costs.
