IN Workforce Development has filed a law suit against Sherry Cooper, 3280 W CR 450 N, NV According to the suit filed, Cooper claimed benefits during 2008, 2009, 2010, 2011, 2012, and 2013. An investigation by the Department revealed she failed to disclose material facts which would have made her ineligible to receive unemployment insurance benefits. As a result, the Department overpaid unemployment benefits to Cooper in the amount of $25,167. Pursuant to Indiana Code, the Department can receive civil penalties where an individual has not disclosed facts to make them ineligible. In this case, a penalty of $15,924.75 is assessed. Cooper failed to respond or appeal the Determinations of Eligibility, and has therefore exhausted all remedies allowed under the law. The final balance owed is $35,360. Plus interest at 0.5% per month (one-half of 1 percent). The State asks the court to enter an order enforcing the determination and order Cooper to pay the money owed.
