Judge Jon Webster has denied 3 requests for placement in a Community Transition Program (CTP): Chavis F. Rodgers was convicted of operating a vehicle as a habitual traffic violator, a D felony, on Sept. 27, 2012 and sentenced to 18 months on home detention. Then, in 2013 he was convicted of unlawful possession of marijuana with a prior conviction, a D felony, He was sentenced on May 22, 2013 to 2 years to be served consecutively to the above. Rodgers admitted violating home detention on May 22, 2013 and sentenced to 547 days to be served consecutively to the marijuana conviction. The judge noted his request was denied in part because he violated home detention and was convicted of a new crime. Stacy L. Cottrill was convicted of identity deception , a D felony, and sentenced on Feb. 23, 2013 to 180 days to be served consecutively to a felony case in Ripley County. Derick L. Montwheler was convicted of battery resulting in bodily injury with prior conviction, a D felony, and sentenced on Jan. 24, 2013 to 3 years. In both of these cases, the judge noted sentences were pursuant to a written, counseled plea agreement that did not take into consideration early release to a CTP. Thus, the court is without authority to modify.
